By accessing or using AussieMotor.com.au, creating an account, posting a listing, contacting a seller or dealer, submitting an enquiry, or using any platform feature, you agree to be bound by these Terms and Conditions, our [Privacy Policy], our [Cookie Policy], and any other policies published on AussieMotor.com.au.

AussieMotor provides the marketplace platform. Any vehicle sale, purchase, inspection, finance arrangement, insurance arrangement, transfer, registration, warranty, or after-sale matter is between the relevant buyer, seller, dealer, or third-party provider.

Acceptance of Terms

By using AussieMotor.com.au, you confirm that you have read, understood, and accepted these Terms.

These Terms apply to all users of AussieMotor, including visitors, registered users, private sellers, dealers, advertisers, content contributors, and anyone who accesses or interacts with our services.

You must use AussieMotor only for lawful purposes and in accordance with these Terms.

We may update these Terms from time to time. If we make changes, we may update the “Effective Date” or “Last Reviewed” date shown on this page. Your continued use of AussieMotor after updated Terms are published means you accept the updated Terms.

You may need an account to use certain features, such as posting listings, saving vehicles, contacting sellers, managing dealer inventory, or receiving notifications.

When creating or using an account, you agree to:

  • provide accurate, current, and complete information

  • keep your login details secure

  • not share your account with unauthorised persons

  • update your account information if it changes

  • notify us if you suspect unauthorised access

  • use your account only for lawful and genuine marketplace activity

You must not create an account using false, misleading, stolen, or unauthorised information.

We may suspend, restrict, or close an account if we reasonably believe it has been used in breach of these Terms, for fraud, spam, fake listings, suspicious activity, security risks, or unlawful conduct.

Users under 18 should use AussieMotor only with involvement and permission from a parent or guardian.

Vehicle Listings

Users and dealers may be able to create and manage vehicle listings on AussieMotor.

When posting or managing a listing, you agree that:

  • you have the legal right or authority to advertise the vehicle

  • the listing information is accurate, complete, current, and not misleading

  • the vehicle price, condition, mileage, year, images, location, variant, specifications, and availability are correct to the best of your knowledge

  • you will not post fake, duplicate, stolen, illegal, expired, unavailable, or misleading listings

  • you will update or remove a listing when the vehicle is sold, unavailable, withdrawn, or materially changed

  • you will not use misleading pricing, bait advertising, false discounts, or deceptive claims

The Australian Consumer Law prohibits misleading or deceptive conduct and false or misleading claims. The ACCC states that online businesses must not make false or misleading claims on their own website, social media, or other platforms.  

AussieMotor may review, moderate, edit, hide, reject, suspend, or remove listings at any time if we reasonably believe they breach these Terms, our policies, applicable laws, or platform quality standards.

We do not guarantee that any listing is accurate, genuine, complete, available, or suitable for purchase.

Buyers, Sellers, and Dealers

AussieMotor helps buyers, sellers, and dealers connect. We are not responsible for completing or guaranteeing any transaction between users.

Buyers should make their own enquiries before purchasing a vehicle. This may include:

  • physically inspecting the vehicle

  • arranging an independent mechanical inspection

  • checking the Personal Property Securities Register where appropriate

  • verifying ownership, registration, roadworthy status, finance status, written-off status, odometer history, service history, and identity of the seller

  • confirming price, fees, transfer costs, stamp duty, registration, warranty, and any other charges

  • obtaining independent legal, financial, insurance, or mechanical advice where needed

Sellers and dealers are responsible for providing accurate information and complying with all laws that apply to their sale or advertisement.

Private sales and dealer sales may involve different rights and obligations. The ACCC notes that many consumer guarantees do not apply to products sold by private sellers, while businesses selling products or services to consumers must comply with the Australian Consumer Law.  

AussieMotor is not responsible for disputes, losses, defects, payment issues, misrepresentations, transfer delays, finance issues, warranty issues, vehicle condition, or after-sale matters between buyers, sellers, dealers, or third-party providers.

Dealer Accounts and Dealer Responsibilities

Dealers may be able to create dealer profiles, publish inventory, receive leads, manage enquiries, and use dealer dashboard tools.

Dealers agree to:

  • provide accurate business and contact information

  • advertise only vehicles they are authorised to sell

  • keep inventory and pricing up to date

  • avoid misleading, deceptive, or bait advertising

  • comply with applicable licensing, motor dealer, consumer, privacy, advertising, tax, and fair trading obligations

  • respond to enquiries professionally

  • honour any representations they make to users

  • remove or update listings that are sold, unavailable, or materially changed

AussieMotor may verify dealer information, request supporting documentation, restrict dealer tools, suspend dealer accounts, remove listings, or refuse dealer access where reasonably necessary.

Dealer listing visibility, ranking, leads, analytics, badges, and promotional placement may depend on package type, listing quality, market rules, moderation status, user behaviour, availability, and platform algorithms.

Prices, Fees, Paid Services, and Promotions

Vehicle prices displayed on AussieMotor are provided by sellers, dealers, or relevant data sources. Prices may change without notice.

Unless clearly stated otherwise, vehicle prices may exclude:

  • on-road costs

  • registration

  • stamp duty

  • transfer fees

  • government charges

  • delivery costs

  • dealer delivery or administration fees

  • insurance

  • finance charges

  • optional extras

  • inspection costs

  • warranty or service plan costs

If AussieMotor offers paid services, such as featured ads, promoted listings, dealer packages, advertising placements, subscriptions, or premium tools, the relevant price, duration, inclusions, limitations, and payment terms will be shown at the time of purchase or in the applicable package information.

You must not make misleading claims about prices, discounts, savings, comparisons, or promotions. Australia has strict rules against misleading pricing and discount representations.  

Unless otherwise stated, paid promotional services are for advertising placement or platform visibility only. We do not guarantee enquiries, sales, ranking, traffic, or revenue.

Refunds for AussieMotor Paid Services

If AussieMotor charges for a service, any refund rights will depend on the service purchased, the circumstances, these Terms, and any rights you may have under the Australian Consumer Law.

Nothing in these Terms limits consumer guarantees, rights, or remedies that cannot be excluded under Australian law. The ACCC explains that businesses must meet consumer guarantees when they sell products or services to consumers.  

Subject to any non-excludable rights, fees for paid advertising, featured listings, dealer packages, or promotional services may be non-refundable once the service has commenced, been delivered, or been made available.

Vehicle Information, Reviews, Comparisons, and Content

AussieMotor may publish vehicle specifications, prices, images, blogs, reviews, comparisons, guides, FAQs, and other automotive content.

This content is provided for general information only. While we aim to keep information accurate and useful, vehicle data may vary by:

  • model year

  • variant

  • trim level

  • state or territory

  • dealer stock

  • manufacturer updates

  • optional equipment

  • import status

  • used vehicle condition

  • market availability

By submitting content to AussieMotor, you confirm that:

  • the content does not infringe another person’s rights

  • the content is not offensive, defamatory, discriminatory, abusive, threatening, fraudulent, spam, or unlawful

  • the content does not contain malware, harmful code, or unauthorised advertising

You grant AussieMotor a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish, distribute, resize, edit, moderate, and promote your submitted content for operating, marketing, improving, and providing our services.

We may moderate, edit, refuse, remove, or restrict user content at any time.

Communications Between Users

AussieMotor may provide enquiry forms, lead forms, call buttons, email links, messaging tools, WhatsApp links, or other communication features.

You agree to use these features only for genuine automotive-related communication.

You must not use AussieMotor communication tools for:

  • spam

  • scams

  • harassment

  • phishing

  • unrelated marketing

  • unlawful offers

  • impersonate another person, dealer, business, or representative

  • scrape, copy, harvest, or commercially exploit data without permission

  • interfere with, overload, hack, reverse engineer, or disrupt the website

  • upload malware, viruses, bots, scripts, or harmful code

  • bypass security, moderation, verification, rate limits, or access controls

  • collect user data without permission

  • send spam, scams, phishing, or fraudulent offers

  • use the platform for unlawful, unsafe, or harmful activity

  • breach any applicable Australian law, regulation, court order, or third-party right

We may suspend accounts, remove listings, restrict access, block communications, report conduct to authorities, or take legal action where appropriate.

Intellectual Property

AussieMotor.com.au, including its layout, branding, design, software, database structure, text, graphics, icons, logos, images, code, and content, is owned by AussieMotor or used under licence unless stated otherwise.

You must not copy, reproduce, modify, distribute, sell, scrape, frame, mirror, or commercially exploit any part of AussieMotor without written permission, except as permitted by law.

You may share public AussieMotor links for normal personal, editorial, or social use, provided you do not misrepresent ownership or misuse our content.

  • that any vehicle is available, roadworthy, safe, defect-free, finance-free, or accurately described

  • that search rankings, featured listings, or dealer placement will remain constant

  • that paid promotions will produce a specific result

Any analytics, reports, views, clicks, lead counts, ranking indicators, or performance estimates are provided for general platform information and may not be complete, exact, or error-free.

Consumer Law and Non-Excludable Rights

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, remedy, or protection that cannot be excluded under the Australian Consumer Law or other applicable laws.

If we provide services to you as a consumer under the Australian Consumer Law, our services come with guarantees that cannot be excluded where the law applies.

To the maximum extent permitted by law, and subject to any non-excludable rights, our liability for a failure to comply with a consumer guarantee in relation to services may be limited to supplying the services again or paying the cost of having the services supplied again.

Limitation of Liability

To the maximum extent permitted by law, and subject to any non-excludable rights, AussieMotor, its directors, employees, contractors, partners, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or economic loss arising from or related to your use of AussieMotor.

  • unauthorised account access caused by your failure to protect login details

  • platform downtime or technical issues

Nothing in this clause excludes liability that cannot be excluded by law.

Indemnity

You agree to indemnify AussieMotor, its directors, employees, contractors, partners, and service providers from and against claims, losses, damages, liabilities, costs, and expenses arising from:

  • your use or misuse of AussieMotor

  • your listings, images, content, enquiries, or communications

  • your breach of these Terms

  • your breach of applicable laws or third-party rights

  • your transaction or dispute with another user, seller, buyer, dealer, or third party

  • information you provide that is false, misleading, unlawful, or infringing

This indemnity does not apply to the extent the claim, loss, or liability is caused by AussieMotor’s own unlawful conduct, negligence, or breach of non-excludable obligations.

Suspension and Termination

We may suspend, restrict, or terminate your access to AussieMotor if we reasonably believe that:

  • you breached these Terms

  • you posted fake, misleading, illegal, or suspicious listings

  • your account creates fraud, security, legal, or safety risks

  • you misuse communication tools

  • you attempt to bypass moderation, security, or platform controls

  • your conduct may harm AussieMotor, users, dealers, or the public

  • we are required or authorised to do so by law

We may also remove listings, disable dealer profiles, restrict enquiries, block messages, or refuse future access.

You may stop using AussieMotor at any time.

Governing Law and Jurisdiction

These Terms are governed by the laws of Australia.

Where a state or territory law must apply to a particular dispute, the relevant Australian state or territory law may apply.

Subject to any rights you may have under applicable consumer protection laws, you agree that disputes relating to these Terms or AussieMotor will be dealt with by courts or tribunals with jurisdiction in Australia.
